VONDEL PRIVACY POLICY

This English version is provided for information purposes only. In case of any discrepancy between the Turkish and English versions, the Turkish version shall prevail.

Yiğit Ünalan, operating under the name "Vondel", located at İdealtepe Mah. Cuma Sk. Elif İdealist No: 1 İç Kapı No: 5 Maltepe/İstanbul and registered with the Küçükyalı Tax Office under tax number 9120309518 ("Vondel"), values the privacy of the personal data of users of the Vondel mobile application (the "Application") and the vondelexcellence.com website (the "Website"). This Privacy Policy (the "Policy") explains what information is collected, how it is used, with whom it is shared and how it is protected. The Policy applies together with the Vondel User Privacy Notice and the Website Visitor Privacy Notice prepared under Law No. 6698 on the Protection of Personal Data (the "KVKK"); in case of conflict, the privacy notices prevail.

1. INFORMATION WE COLLECT

When you open an account in the Application, your name and surname, date of birth, gender and e-mail address are collected; to create your digital recognition model, your height, weight, answers to the question flow, photographs and images taken with the device camera within the Application for posture analysis and fitness tests together with posture analysis results, fitness test measurements and results, and pain and discomfort you report during movements; your program and session records, difficulty ratings and feedback; your chats with agents; your notification preferences; if you use the Application under corporate use, the corporate customer and department you are affiliated with and, if you participate in team challenges, your nickname and leaderboard information; if you use paid features, purchase and subscription information; and, for the secure operation of the Application, your user number, login records, IP address, device and application version information and device notification token are collected. On the Website, your name and surname, e-mail address, telephone number, company/institution name, title and message are collected through forms, and the information described in the Cookie Policy is collected through cookies. Data qualifying as health information are processed only with your explicit consent and through separate statements.

2. OUR PURPOSES FOR USING INFORMATION

• Creating your account, ensuring authentication and session security
• Creating your digital recognition model, evaluating posture analysis and fitness tests, preparing a movement and exercise program tailored to you and updating it after sessions
• Answering your questions through agents and reviewing answers you flag as incorrect
• Sending exercise reminder notifications, responding to your requests and complaints, providing information
• Within corporate use, invitation and seat management, reporting anonymised aggregate results to the corporate customer, and, with your explicit consent, conducting in-company rankings and competitions (team challenges and the leaderboard)
• Carrying out paid feature and subscription transactions, ensuring information security, developing the Application, fulfilling legal obligations and protecting rights

3. TRANSFER OF YOUR INFORMATION TO THIRD PARTIES

Your information is shared, in accordance with the conditions set out in Articles 8 and 9 of the KVKK, with suppliers from which services are obtained for the continuity, operation and development of the Application and the Website and for finance-accounting and legal consultancy services; with your explicit consent, with the supplier located abroad that provides the artificial intelligence language model service for agent chats; within corporate use, with the corporate customer in respect of your e-mail address, the allocation status of your seat and anonymised aggregate results; if you participate in in-company rankings and competitions with your explicit consent, with other users within the same corporate customer in respect of your nickname, department and ranking and competition information; and, upon their requests based on law, with legally authorised public institutions and organisations. Notifications and in-app purchases are carried out through the infrastructure of the mobile operating system and app store provider you use. Vondel does not sell your information to third parties for advertising or marketing purposes.

4. STORAGE AND PROTECTION OF YOUR INFORMATION

Your information is stored for the period necessary for the purpose for which it is processed and for the periods stipulated in the legislation; at the end of these periods it is erased, destroyed or anonymised. Vondel takes technical and administrative measures in accordance with the legislation to protect your information against unauthorised access, loss and misuse. You can delete your account through the account closure step in the Application or by applying to info@vondelexcellence.com; records subject to retention obligations arising from legislation are retained for that period.

5. ACCURACY AND CURRENCY OF YOUR INFORMATION

Since your digital recognition model and program are created according to the information you provide, it is important that your information is accurate and up to date. You can update your information through the Application or notify it to info@vondelexcellence.com.

6. REDIRECTIONS TO THIRD PARTIES

The Application and the Website may contain links to third-party sites or services, including app stores. Vondel is not responsible for the privacy policies and practices of these third parties.

7. CHILDREN

The Application and the Website are intended for persons who are at least 18 years old; Vondel does not knowingly collect personal data of persons under the age of 18.

8. YOUR RIGHTS

You may exercise your rights under Article 11 of the KVKK by applying in writing to İdealtepe Mah. Cuma Sk. Elif İdealist No: 1 İç Kapı No: 5 Maltepe/İstanbul or to the e-mail address info@vondelexcellence.com; applications are concluded within 30 days at the latest. You may withdraw your explicit consent at any time through the Application.

9. CHANGES TO THE POLICY

Vondel reserves the right to make changes and updates to this Policy; the current Policy is published in the Application and on the Website and is effective from the date of publication.

10. NATURE OF THE APPLICATION

The Application is a general healthy living, movement and exercise service; it is not a health service, and its content, scan results, digital recognition model outputs, programs and agent answers do not constitute medical diagnosis, treatment or medical advice. The provisions regarding the use of the Application are set out in the Terms of Use.
